This End-User License Agreement ("EULA") is a legal agreement between you (an individual or a single entity) and BusyImages Inc. ("BusyImages") for the free version of BusyRay software ("BusyRay-f").
YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA BY INSTALLING, COPYING, OR OTHERWISE USING BUSYRAY-F.
BY SELECTING THE "Accept" BUTTON, YOU ARE CONSENTING TO BE BOUND BY ALL THE TERMS BELOW.
IF you do not agree to All OF THE terms BELOW, SELECT "Deny" BUTTON AND DO NOT USE BUSYRAY-F SOFTWARE.
BusyImages grants you a nonexclusive nontransferable license to install and use BusyRay-f according to the terms and conditions of this EULA. This EULA permits you to install and use as many copies of BusyRay-f as you need.You may also design, create, test, modify and make unlimited copies of the individual animations and still images obtained through the use of BusyRay-f and distribute it as demonstration of your own work.
You agree with the following prohibitions:
BusyImages reserves all rights not expressly granted to you in this EULA. Copyright and other intellectual property laws protect BusyRay-f. BusyImages own the title, copyright, and other intellectual property rights in BusyRay-f. The structure, organization, and code of BusyRay-f are the trade secrets of BusyImages. Failure to comply with the above restrictions will give BusyImages right to terminate this EULA unilaterally. This EULA does not grant you any intellectual property rights.
BUSYIMAGES PROVIDE THIS SOFTWARE "AS IS" WITHOUT WARRANTIES AND SUPPORT SERVICES OF ANY KIND. THUS, NO WARRANTIES ARE PROVIDED (EXPRESS, IMPLIED, STATUTORY, OR WARRANTIES IN ANY COMMUNICATION WITH YOU). BUSYIMAGES SPECIFICALLY DISCLAIMS ANY WARRANTY INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. BUSYIMAGES DOES NOT WARRANT THAT THE OPERATION OF BUSYRAY-F WILL BE UNINTERRUPTED OR ERROR FREE.
You accept that no software is error free and you are strongly advised to back-up your files regularly.
THERE IS NO WARRANTY OF CORRESPONDENCE TO DESCRIPTION, OF COMPLETENESS OF DATA OR SUPPORTED FEATURES, OF RELIABILITY OR AVAILABILITY, OF ACCURACY OF RESULTS, OF LACK OF VIRUSES, AND OF LACK OF NEGLIGENCE, OF NON-INFRINGEMENT, AND NO WARRANTY TO PROVIDE SUPPORT OR OTHER SERVICES.
DUE TO THE LARGE VARIETY OF POTENTIAL SCENES BUSYRAY-F HAS NOT BEEN TESTED IN ALL SITUATIONS FOR ALL POSSIBLE SCENES. THEREFORE BUSYIMAGES SHALL NOT BE LIABLE IN ANY MANNER FOR THE RESULTS OBTAINED THROUGH THE USE OF BUSYRAY-F. PERSONS USING BUSYRAY-F ARE RESPONSIBLE FOR THE SUPERVISION, MANAGEMENT AND CONTROL. THIS RESPONSIBILITY INCLUDES, BUT IS NOT LIMITED TO, THE DETERMINATION OF APPROPRIATE USES FOR BUSYRAY-F TO ACHIEVE DESIRED RESULTS. PERSONS USING BUSYRAY-F ARE ALSO RESPONSIBLE FOR ESTABLISHING THE ADEQUACY OF INDEPENDENT PROCEDURES FOR TESTING THE RELIABILITY AND ACCURACY OF ANY PROGRAM OUTPUT.
IN NO EVENT WILL BUSYIMAGES BE LIABLE FOR ANY LOSS OR DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO LOSS OF DATA OR PRIVACY, LOST PROFITS, COST OF COVER, BUSINESS INTERRUPTION, PERSONAL INJURY, OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE BUSYRAY-F OR DOCUMENTATION, OR OTHERWISE UNDER OR IN CONNECTION WITH ANY PROVISION OF THIS EULA. THIS PROVISION WILL APPLY EVEN IF BUSYIMAGES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE AND EVEN IN THE EVENT OF THE FAULT, TORT, MISREPRESENTATION, STRICT LIABILITY, AND BREACH OF CONTRACT OR BREACH OF WARRANTY.
YOU AGREE THAT IN NO EVENT WILL BUSYIMAGES BE LIABLE FOR ANY LOSS OR DAMAGES OF ANY KIND WHICH MAY ARISE IN CONJUNCTION WITH THE DISTRIBUTION OR USE OF YOUR USER WORKS. YOU AGREE THAT NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON, THERE IS NO LIABILITY OF BUSYIMAGES UNDER ANY PROVISION OF THIS EULA.
YOU AGREE THAT ENTIRE RISK ARISING OUT OF INSTALLATION, COPYING, AND OTHERWISE USE OR PERFORMANCE OF BUSYRAY-F REMAINS WITH YOU.
BusyImages does not recommend using BusyRay-f in jurisdictions whose law conflicts with provisions 4,5,6,7 of this EULA. Otherwise you voluntarily agree to use BusyRay-f on your own risk.
If any provision of this EULA is found to be invalid, the rest conditions will remain fully effective and the parties will be bound by obligations that approximate, as closely as possible, the effect of the provision found invalid.
This EULA is perpetual until new EULA is accepted by the parties concerned or until termination according to provision 3 of this EULA.
YOU AGREE THAT IT IS COMPLETE AND EXCLUSIVE AGREEMENT BETWEEN YOU AND BUSYIMAGES, WHICH SUPERSEDES ANY OTHER ORAL AND WRITTEN AGREEMENTS, ANY PREVIOUS LICENSE AGREEMENTS AND ANY OTHER COMMUNICATIONS RELATING TO BUSYRAY-F.
YOU CONFIRM THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY ALL OF ITS TERMS AND CONDITIONS.
